This Privacy Policy explains how Tranquility Creative LLC ("Tranquility," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit, create an account for, or use the Tranquility website, platform, dashboards, forms, applications, services, and related communications, collectively referred to as the "Service."

Tranquility is a creative strategy and sourcing platform for businesses and creators. This Privacy Policy applies to business users, creator users, creator applicants, prospective customers, and other individuals who interact with the Service.

Information We Collect

We collect personal information that you provide to us, information generated through your use of the Service, information received from service providers involved in providing the Service, and limited technical information needed to operate and secure the Service.

A. Account and Authentication Information

When you create or use an account, we may collect:

a.Your name.

b.Your email address.

c.Your account type or role, such as business or creator.

d.Authentication identifiers and account records.

e.Information associated with account verification, password recovery, login activity, and account security.

f.Your acceptance of the Terms of Use and acknowledgment of this Privacy Policy, including applicable timestamps and document version records.

If you choose to create or access an account through Google or Apple sign-in, we may receive information made available through that sign-in process, such as your name, email address, account identifier, and authentication confirmation, subject to your settings and the applicable provider's practices.

B. Business User and Creative Map Information

When a business user creates or confirms a business profile, requests a complimentary Creative Map, purchases a strategy or sourcing service, or communicates with Tranquility regarding a project, we may collect:

a.Your name and business contact information.

b.Business name, business type, industry, and location.

c.Website and social-media links or handles.

d.Current social-media or content challenges.

e.Growth goals, target audience, timeline, budget range, and preferred creator type.

f.Content needs, project information, requested services, approvals, and related responses.

g.Purchased-service records and communications regarding Creative Map, Creative Strategy, Creative Blueprint, Creative Concierge, or production-related opportunities.

A complimentary Creative Map request requires a business account or sign-in and confirmation of applicable business profile information before the request is finalized.

C. Creator Applicant and Creator Profile Information

When a creator creates an account, submits an application for consideration, completes a creator profile, or participates in a project opportunity, we may collect:

a.Name, email address, phone number, location, zip code, and travel radius.

b.Portfolio links, website links, social-media links, and creator profile images you choose to submit.

c.Creator type, services offered, niches, equipment, workflow information, pricing information, availability, and project preferences.

d.Application responses, notes, review status, and approval or platform-status information.

e.Communications regarding creator review, admission to the vetted creator network, potential opportunities, accepted projects, or payment-related matters.

A creator must create an account and acknowledge applicable legal documents before formally submitting an application for consideration. Creating a creator account or submitting an application does not guarantee admission to Tranquility's vetted creator network or receipt of paid opportunities.

D. Project and Service Information

When a business and an approved creator participate in a production engagement or related service, we may collect and maintain information reasonably necessary to scope, coordinate, administer, and document that engagement, including:

a.Project briefs, objectives, locations, dates, content requirements, deliverables, approval decisions, and production details.

b.Participating business and creator information.

c.Quotes, fees, payment status, applicable service selections, and project records.

d.Communications relating to coordination, revisions, delivery, rights, permissions, issues, or support.

At launch, Tranquility coordinates project-deliverable delivery manually rather than operating an in-platform production-deliverable storage and download system. We may nevertheless retain communications or materials transmitted to us as reasonably necessary to provide services, maintain business records, resolve issues, and comply with applicable obligations.

E. Payment and Transaction Information

When you make a paid purchase or participate in a paid transaction through the Service, payment processing is provided through Stripe.

We may collect or receive transaction-related information such as:

a.Your account and customer identifiers.

b.Product or service purchased.

c.Transaction amount, currency, date, and payment status.

d.Stripe transaction, checkout-session, payment-intent, account, or similar reference identifiers.

e.Information regarding credits, refunds, disputes, failed payments, or production-payment status, where applicable.

Payment-card information is submitted directly to Stripe through the applicable payment experience. Tranquility does not store full payment-card numbers through its own application databases.

Stripe processes information according to its own terms and privacy practices.

F. Communications

We may collect communications you send to or receive from Tranquility, including:

a.Support requests.

b.Account, security, or password-related communications.

c.Service, Creative Map, project, application, or creator-network communications.

d.Payment or transaction communications.

e.Materials voluntarily sent through email or another agreed communication method.

At launch, Tranquility uses service and transactional communications necessary to provide the Service. Tranquility does not operate a promotional marketing-email program at launch.

G. Technical and Essential Service Information

When you use the Service, we and our service providers may process limited technical information needed to operate, protect, and maintain the Service, such as:

a.Browser or device information.

b.IP address and security-related network information.

c.Authentication-session information.

d.Date and time of access.

e.Request, error, security, or operational log information.

f.Information stored through essential browser storage as described below.

At launch, Tranquility does not use advertising pixels, marketing analytics tools, session-replay tools, or cross-site behavioral advertising technologies.

How We Use Information

We may use personal information to:

a.Create, authenticate, administer, and secure accounts.

b.Provide account access, dashboards, profiles, and role-based functionality.

c.Receive and evaluate business profiles, Creative Map requests, creator applications, and creator profiles.

d.Provide Creative Maps, strategy services, sourcing services, creator-network functionality, and project coordination.

e.Use artificial intelligence-assisted tools to generate or prepare requested service outputs as described below.

f.Identify, review, source, or coordinate creators for approved business opportunities.

g.Process paid purchases and production-related payment transactions through Stripe.

h.Send authentication, account, security, service, project, application, payment, administrative, and policy communications.

i.Maintain records of accepted terms, policy acknowledgments, purchases, projects, approvals, communications, and applicable agreements.

j.Provide customer support and respond to questions or requests.

k.Protect against fraud, misuse, unauthorized access, unlawful activity, security incidents, and violations of our agreements.

l.Comply with legal obligations, enforce applicable agreements, resolve disputes, and establish or defend legal claims.

m.Improve and maintain the functionality, reliability, and security of the Service.

Artificial Intelligence-Assisted Product Generation

Tranquility may use artificial intelligence-enabled tools and related service providers to assist in generating or preparing certain requested service outputs, including Creative Maps, creative strategy materials, content recommendations, scopes, assessments, and related deliverables.

When you submit information for a service that uses artificial intelligence-assisted generation, information relevant to preparing the requested output may be processed through our artificial intelligence service providers. This information may include business profile information, website or social-media links, business goals, content challenges, target audience information, timeline, budget range, preferred creator type, project information, and other responses you provide for the requested service.

At launch, Tranquility does not use artificial intelligence-enabled tools to automatically:

a.Approve or reject creator applications.

b.Determine admission to the vetted creator network.

c.Select a creator for a specific production engagement without required review and approval.

d.Determine user eligibility for access to services.

e.Make payment, payout, refund, or dispute decisions.

f.Enter into binding production commitments on behalf of a business or creator.

Tranquility may retain submitted information and generated outputs to provide the requested service, maintain business records, resolve issues, protect the platform, and improve its service delivery. Tranquility will not use customer or creator submissions to train general-purpose third-party artificial intelligence models unless separately disclosed or consented to.

If Tranquility later introduces materially different uses of artificial intelligence, including automated decision-making affecting users or creators, we will update this Privacy Policy and provide additional notice or obtain consent where required by applicable law.

How We Disclose Information

We may disclose information as described in the following subsections.

A. Service Providers

We may disclose information to vendors and service providers that help us operate the Service, including providers supporting:

a.Website hosting and deployment.

b.Database hosting, authentication, account management, and private storage.

c.Email delivery and transactional communications.

d.Artificial intelligence-assisted product generation and related processing services.

e.Payment processing.

f.Security, fraud prevention, support, and technical operations.

At launch, these providers include or may include Supabase, Stripe, Google sign-in services where selected by the user, artificial intelligence-enabled product-generation providers used to prepare requested service outputs, and other vendors reasonably necessary to deliver, protect, and administer the Service.

Service providers may process information subject to their agreements with us and their own applicable privacy practices.

B. Between Businesses and Creators for Approved Opportunities

When reasonably necessary to evaluate, coordinate, or perform an approved creator opportunity or production engagement, we may disclose relevant business and creator information between the applicable participants.

For example, we may provide information reasonably necessary to understand the opportunity, evaluate fit, prepare a quote, approve a project, coordinate production, deliver agreed work, manage payment status, or resolve project issues.

We do not make a creator applicant's full application publicly available merely because the creator applies.

If a creator is approved into the vetted creator network, certain creator profile, portfolio, service, location, or work-example information may be shared with prospective business customers or displayed as part of the creator network, consistent with applicable creator agreements, project permissions, and platform functionality.

C. Payment Processing

We disclose information to Stripe as reasonably necessary to process paid purchases, manage payment status, facilitate applicable production-payment transactions, prevent fraud, handle refunds or disputes, and maintain transaction records.

Stripe may collect and use payment and transaction information in accordance with its own terms and privacy practices.

D. Professional Advisors and Contractors

We may disclose information to attorneys, accountants, consultants, developers, or other contractors who require access to assist Tranquility with legitimate business, technical, compliance, security, or professional needs, subject to appropriate confidentiality or contractual obligations where applicable.

E. Legal, Safety, and Enforcement Purposes

We may disclose information if we believe doing so is reasonably necessary to:

a.Comply with applicable law, regulation, subpoena, court order, or governmental request.

b.Enforce our agreements or protect our rights.

c.Prevent fraud, misuse, security incidents, unlawful conduct, or harm.

d.Protect the safety, rights, property, or security of Tranquility, users, creators, businesses, or others.

F. Business Transfers

We may disclose or transfer information in connection with an actual or contemplated merger, acquisition, financing, reorganization, sale of assets, transfer of the Service, bankruptcy, or similar business transaction, subject to applicable law.

No Sale of Personal Information or Targeted Advertising Sharing

At launch, Tranquility does not sell personal information for monetary consideration.

At launch, Tranquility does not share personal information for cross-context behavioral advertising or targeted advertising, and we do not use advertising pixels, third-party behavioral analytics tools, or session-replay tools on the Service.

If these practices change in the future, we will update this Privacy Policy and provide any choices or notices required under applicable law before applying material new practices to personal information where required.

Cookies and Essential Browser Storage

At launch, Tranquility does not use advertising cookies or analytics cookies.

The Service may use essential browser storage or similar technology necessary for platform functionality, including:

a.Authentication session persistence, so users can remain securely signed in and access appropriate account features.

b.Temporary session storage associated with an account-creation authentication flow, including temporarily preserving legal-acknowledgment version information during an approved third-party sign-in redirect.

c.Security, fraud-prevention, or operational functionality reasonably necessary to operate the Service.

These technologies are used for essential service functionality rather than advertising or cross-site tracking.

Do Not Track Signals

Because Tranquility does not engage in cross-site behavioral tracking or targeted-advertising sharing at launch, the Service does not respond differently to browser "Do Not Track" signals.

Data Retention

We retain personal information for as long as reasonably necessary to:

a.Provide the Service and maintain your account.

b.Review and manage business profiles, creator applications, creator profiles, services, opportunities, and projects.

c.Maintain payment, transaction, agreement, consent, and business records.

d.Communicate with you and respond to requests.

e.Comply with legal, accounting, tax, reporting, security, and contractual obligations.

f.Resolve disputes, prevent fraud or abuse, and enforce our agreements.

Retention periods may vary depending on the type of information and the reason it is maintained.

You may request deletion of certain information as described below. We may retain information when required or permitted for legitimate business or legal purposes, including contractual records, payment records, consent records, security records, dispute-resolution information, or records required for legal or regulatory compliance.

Information Security

We use reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no website, platform, database, transmission method, or storage system can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your login credentials and promptly notifying us if you believe your account or information has been compromised.

Your Choices and Requests

a.Accessing or correcting certain personal information associated with your account.

b.Updating your business or creator profile information.

c.Requesting deletion of certain personal information, subject to applicable retention obligations.

d.Asking questions about our data practices.

e.Exercising privacy rights available to you under applicable law.

We may need to verify your identity before completing a request. We may deny or limit a request where permitted by law, including where information must be retained for payment, contractual, security, fraud-prevention, dispute-resolution, legal, or compliance purposes.

State Privacy Rights

Depending on where you reside and whether applicable legal thresholds or requirements apply to Tranquility, you may have rights relating to your personal information, such as rights to request access, correction, deletion, portability, or information about certain disclosures or processing activities.

Tranquility does not discriminate against users for exercising privacy rights available under applicable law.

Third-Party Websites and Services

The Service may contain links to third-party websites, portfolio sites, social-media pages, payment processors, or identity providers.

This Privacy Policy does not govern the privacy practices of third parties. Your use of third-party websites or services is subject to their separate privacy policies and terms.

Children's Privacy

The Service is intended for individuals who are at least 18 years old. We do not knowingly collect personal information from children under 13.

If you believe a child has submitted personal information to Tranquility, contact us at support@usetranquility.com so that we can evaluate and address the matter appropriately.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in the Service, our information practices, applicable law, or operational requirements.

When we update this Privacy Policy, we will update the Effective Date and Version stated at the top of the policy.

If a change is material, we may provide notice through the Service, by email, or through another reasonable method. Where required or appropriate, we may require renewed acknowledgment or obtain consent before applying materially different practices to personal information.
