Tranquility Privacy Policy

This Privacy Policy explains how Tranquility Creative LLC ("Tranquility," "we," "us," or "our") collects, uses, discloses, and protects personal information when you visit, create an account for, or use the Tranquility website, platform, dashboards, forms, applications, services, and related communications, collectively referred to as the "Service."

Tranquility is a creative strategy and sourcing platform for businesses and creators. This Privacy Policy applies to website visitors, business users, creator users, creator applicants, prospective customers, and other individuals who interact with the Service.

Information We Collect

We collect personal information that you provide to us, information generated through your use of the Service, information received from service providers involved in providing the Service, and technical information in connection with operating and securing the Service.

A. Account and Authentication Information

When you create or use an account, we may collect:

  1. Your name.
  2. Your email address.
  3. Your account type or role, such as business or creator.
  4. Authentication identifiers and account records.
  5. Information associated with account verification, password recovery, login activity, and account security.

If you choose to create or access an account through Google or Apple sign-in, we may receive information made available through that sign-in process, such as your name, email address, account identifier, and authentication confirmation, subject to your settings and the applicable provider's practices.

B. Business User and Creative Map Information

When a business user creates or confirms a business profile, requests a complimentary Creative Map, purchases a strategy or sourcing service, or communicates with Tranquility regarding a project, we may collect:

  1. Your name and business contact information.
  2. Business name, business type, industry, and location.
  3. Website and social-media links or handles.
  4. Current social-media or content challenges.
  5. Growth goals, target audience, timeline, budget range, and preferred creator type.
  6. Content needs, project information, requested services, approvals, and related responses.
  7. Purchased-service records and communications regarding Creative Map, Creative Strategy, Creative Blueprint, Creative Concierge, or production-related opportunities.

C. Creator Applicant and Creator Profile Information

When a creator creates an account, submits an application for consideration, completes a creator profile, or participates in a project opportunity, we may collect:

  1. Name, email address, phone number, location, zip code, and travel radius.
  2. Taxpayer identification number, in connection with collecting a W-9.
  3. Portfolio links, website links, social-media links, and creator profile images you choose to submit.
  4. Creator type, services offered, niches, equipment, workflow information, pricing information, availability, and project preferences.
  5. Application responses, notes, review status, and approval or platform-status information.
  6. Communications regarding creator review, admission to the vetted creator network, potential opportunities, accepted projects, or payment-related matters.

D. Project and Service Information

When a business and an approved creator participate in a production engagement or related service, we may collect and maintain information reasonably necessary to scope, coordinate, administer, and document that engagement, including:

  1. Project briefs, objectives, locations, dates, content requirements, deliverables, approval decisions, and production details.
  2. Participating business and creator information.
  3. Quotes, fees, payment status, applicable service selections, and project records.
  4. Communications relating to coordination, revisions, delivery, rights, permissions, issues, or support.

E. Payment and Transaction Information

When you make a purchase or participate in a paid transaction through the Service, payment processing is provided through Stripe.

We may collect or receive transaction-related information such as:

  1. Your account and customer identifiers.
  2. Product or service purchased.
  3. Transaction amount, currency, date, and payment status.
  4. Stripe transaction, checkout-session, payment-intent, account, or similar reference identifiers.
  5. Information regarding credits, refunds, disputes, failed payments, or production-payment status, where applicable.

Payment-card information is submitted directly to Stripe through the applicable payment experience. Tranquility does not store full payment-card numbers through its own application databases.

Stripe processes information according to its own terms and privacy practices.

F. Communications

We may collect communications you send to or receive from Tranquility, including:

  1. Support requests.
  2. Account, security, or password-related communications.
  3. Service, Creative Map, project, application, or creator-network communications.
  4. Payment or transaction communications.
  5. Materials voluntarily sent through email or another agreed communication method.

G. Technical and Essential Service Information

When you use the Service, we and our service providers may process limited technical information needed to operate, protect, and maintain the Service, such as:

  1. Browser or device information.
  2. IP address and security-related network information.
  3. Authentication-session information.
  4. Date and time of access.
  5. Request, error, security, or operational log information.
  6. Your acceptance of the Terms of Service and acknowledgment of this Privacy Policy, including applicable timestamps and document version records.
  7. Information stored through essential browser storage as described below.

How We Use Information

We use personal information to provide the Services and connect businesses and creators. We may also use personal information to:

  1. Create, authenticate, administer, and secure accounts.
  2. Provide account access, dashboards, profiles, and role-based functionality.
  3. Receive and evaluate business profiles, Creative Map requests, creator applications, and creator profiles.
  4. Provide Creative Maps, strategy services, sourcing services, creator-network functionality, and project coordination.
  5. Use artificial intelligence-assisted tools to generate or prepare requested service outputs as described below.
  6. Identify, review, source, or coordinate creators for approved business opportunities.
  7. Process paid purchases and production-related payment transactions through Stripe.
  8. Send authentication, account, security, service, project, application, payment, administrative, and policy communications.
  9. Market and advertise the Service, including by email. Please note that you can opt out of marketing emails by clicking “unsubscribe.”
  10. Maintain records of accepted terms, policy acknowledgments, purchases, projects, approvals, communications, and applicable agreements.
  11. Provide customer support and respond to questions or requests.
  12. Protect against fraud, misuse, unauthorized access, unlawful activity, security incidents, and violations of our agreements.
  13. Comply with legal obligations, enforce applicable agreements, resolve disputes, and establish or defend legal claims.
  14. Improve and maintain the functionality, reliability, and security of the Service.

Artificial Intelligence-Assisted Product Generation

Tranquility may use artificial intelligence-enabled tools and related service providers to assist in generating or preparing certain requested service outputs, including Creative Maps, creative strategy materials, content recommendations, scopes, assessments, and related deliverables.

When you submit information for a service that uses artificial intelligence-assisted generation, information relevant to preparing the requested output may be processed through our artificial intelligence service providers. This information may include business profile information, website or social-media links, business goals, content challenges, target audience information, timeline, budget range, preferred creator type, project information, and other responses you provide for the requested service.

How We Disclose Information

We may disclose information as described in the following subsections.

A. Service Providers

We may disclose information to vendors and service providers that help us operate the Service, including providers supporting:

  1. Website hosting and deployment.
  2. Database hosting, authentication, account management, and private storage.
  3. Email delivery and transactional communications.
  4. Artificial intelligence-assisted product generation and related processing services.
  5. Payment processing.
  6. Security, fraud prevention, support, and technical operations.

We may also disclose personal information to other vendors reasonably necessary to deliver, protect, and administer the Service.

B. Between Businesses and Creators for Approved Opportunities

When reasonably necessary to evaluate, coordinate, or perform an approved creator opportunity or production engagement, we may disclose relevant business and creator information between the applicable participants.

For example, we may provide information reasonably necessary to understand the opportunity, evaluate fit, prepare a quote, approve a project, coordinate production, deliver agreed work, manage payment status, or resolve project issues.

If a creator is approved into the vetted creator network, certain creator profile, portfolio, service, location, or work-example information may be shared with prospective business customers or displayed as part of the creator network, consistent with applicable creator agreements, project permissions, and platform functionality.

C. Payment Processing

We disclose information to Stripe as reasonably necessary to process paid purchases, manage payment status, facilitate applicable production-payment transactions, prevent fraud, handle refunds or disputes, and maintain transaction records.

Stripe may collect and use payment and transaction information in accordance with its own terms and privacy practices.

D. Professional Advisors and Contractors

We may disclose information to attorneys, accountants, consultants, developers, or other contractors who require access to assist Tranquility with legitimate business, technical, compliance, security, or professional needs, subject to appropriate confidentiality or contractual obligations where applicable.

E. Legal, Safety, and Enforcement Purposes

We may disclose information if we believe doing so is reasonably necessary to:

  1. Comply with applicable law, regulation, subpoena, court order, or governmental request.
  2. Enforce our agreements or protect our rights.
  3. Prevent fraud, misuse, security incidents, unlawful conduct, or harm.
  4. Protect the safety, rights, property, or security of Tranquility, users, creators, businesses, or others.

F. Business Transfers

We may disclose or transfer information in connection with an actual or contemplated merger, acquisition, financing, reorganization, sale of assets, transfer of the Service, bankruptcy, or similar business transaction, subject to applicable law.

Cookies and Essential Browser Storage

The Service may use essential browser storage or similar technology necessary for platform functionality, including:

  1. Authentication session persistence, so users can remain securely signed in and access appropriate account features.
  2. Temporary session storage associated with an account-creation authentication flow, including temporarily preserving legal-acknowledgment version information during an approved third-party sign-in redirect.
  3. Security, fraud-prevention, or operational functionality reasonably necessary to operate the Service.

These technologies are used for essential service functionality rather than advertising or cross-site tracking.

Do Not Track Signals

Because Tranquility does not engage in cross-site behavioral tracking or targeted-advertising sharing at launch, the Service does not respond to browser "Do Not Track" signals.

Data Retention

We retain personal information for as long as reasonably necessary to:

  1. Provide the Service and maintain your account.
  2. Review and manage business profiles, creator applications, creator profiles, services, opportunities, and projects.
  3. Maintain payment, transaction, agreement, consent, and business records.
  4. Communicate with you and respond to requests.
  5. Comply with legal, accounting, tax, reporting, security, and contractual obligations.
  6. Resolve disputes, prevent fraud or abuse, and enforce our agreements.

Retention periods may vary depending on the type of information and the reason it is maintained.

Information Security

We use reasonable administrative, technical, and organizational measures intended to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure.

However, no website, platform, database, transmission method, or storage system can be guaranteed to be completely secure. You are responsible for maintaining the confidentiality of your login credentials and promptly notifying us if you believe your account or information has been compromised.

Your Choices and Requests

You may contact us at support@usetranquility.com to request assistance with updating your business or creator profile information or asking questions about our data practices.

Third-Party Websites and Services

The Service may contain links to third-party websites, portfolio sites, social-media pages, payment processors, or identity providers.

This Privacy Policy does not govern the privacy practices of third parties. Your use of third-party websites or services is subject to their separate privacy policies and terms.

Children's Privacy

The Service is intended for individuals who are at least 18 years old. We do not knowingly collect personal information from children under 13.

If you believe a child has submitted personal information to Tranquility, contact us at support@usetranquility.com so that we can evaluate and address the matter appropriately.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in the Service, our information practices, applicable law, or operational requirements.

When we update this Privacy Policy, we will update the Effective Date and Version stated at the top of the policy.

If a change is material, we may provide notice through the Service, by email, or through another reasonable method. Where required or appropriate, we may require renewed acknowledgment or obtain consent before applying materially different practices to personal information.
